BEHAVIORAL EXPECTATIONS
This policy is adopted by the Board of Education of South Sanpete School District pursuant to UCA 53A-11-901 through 907. It is the intent of the Board to provide every student in the district with the opportunity to learn in an environment, which is safe, conducive to the learning process, and free from unnecessary disruption. Every student is expected to follow rules of conduct, and to show respect for others and to obey persons in authority at the schools.
A student may be suspended/expelled from school for participation in any of the following prohibited conduct when it occurs in a school building, in or on school property, in conjunction with any school sponsored activity, or when it occurs in the presence of or is directed at or against another student or district employee:
- Verbal/physical/sexual harassment or assault on other students (i.e. bullying, fighting, pushing, threatening).
- Vulgar or obscene language
- An unexcused absence or leaving campus during school hours without parents permission (sluff).
- Destruction, damage or theft of property belonging to the school, students, or school personnel (including lockers).
- Blatant disrespect for school personnel; i.e. a student who is rude, discourteous, “talking back,” non-compliant, using vulgarity, or abusive language, as defined by the adult involved while at school and/or all school related activities - on or off campus.
- Cheating and/or plagiarism and other forms of dishonest behavior.
- Any other actions that continually disrupt the educational process–Ephraim Middle School recognizes that every student should have the opportunity to learn in an environment that is safe, conducive to the learning process, and free from any disruptive behavior which creates an imminent danger in regards to bullying.
- Bullying, hazing, and initiation activities that involve hazing or abusive and illegal behaviors that harm victims and negatively impact the school environment. Bullying is defined in District Policy JH-1. Bullying will not be tolerated. “Hazing” means any action taken or situation created that causes, or is reasonably likely to cause harassment, humiliation, bodily danger or physical harm, serious mental or emotional harm, extreme embarrassment, unwelcome touch or personal degradation or loss of dignity of any student. South Sanpete School District Policy prohibits this type of behavior in conjunction with any school activity. Any student that participates in hazing will face immediate disciplinary action. - Continued willful disobedience or open and persistent defiance of proper authority.
- Willful destruction, injury, or defacing of school property.
MANDATORY EXPULSION/SUSPENSION
Students must be suspended/expelled from school for participation in any of the following prohibited conduct when it occurs in a school building, in or on school property, or within 1000 feet of school property or within 1000 feet and in conjunction with any school sponsored activity, or when it occurs in the presence of or is directed at or against another student or a district employee.
- Possession of a weapon, explosive, or flammable material.
- The sale, control, delivery, transfer, distribution of a drug or controlled substance as defined in UCA 58-37-2 or by 21 U.S.C. 801.
- The sale, control or distribution of drug paraphernalia as defined in UCA 58-37a-3.
- Commission of an act involving the use of force or the threatened use of force which, if committed by an adult would be a felony or class A misdemeanor.
- Assaults of a teacher or other individual. (See also 53A-3-502).
HABITUALLY DISRUPTIVE BEHAVIOR
A student may be suspended or expelled if he/she is habitually disruptive and has failed or refused to completely comply with the student’s remedial discipline plan.
- A “habitually disruptive student” is one who has caused disruption in a classroom, on school grounds, in a school vehicle, or at school sponsored activities or events more than five times during a school year and whose behavior was initiated, willful and overt and required the attention of school employees to deal with the disruption.
- When a student has caused his first disruption such as described in the preceding paragraph, the student’s administration or administration’s designee shall develop a remedial discipline plan to assist the student in altering his/her conduct and avoiding the occurrence of another disruption. The administration or designee will review the essential elements of the plan with the student at the time it is implemented.
Suspension/expulsion of a student for misbehavior that is related to a disability may constitute discrimination. Students identified as disabled must be given special considerations. Students with a disability may be suspended/expelled for engaging in conduct that could warrant such action for a non-disabled student only if the special education committee determines the misconduct is not related to the handicapping condition or inappropriate placement time.
The severity and/or repetitive problem behavior will determine which consequences are enforced. The school will attempt to be uniform in dealing with students. However, all student situations differ from one another. Some students will benefit from consequences that are different from another student. The school will attempt to involve parents in determining appropriate action/s and to notify them of future discipline.
The Board hereby delegates its authority to expel/suspend students to administration and vice administrations in each school in the District for up to ten days.
POSSIBLE CORRECTIVE MEASURES
- Telephone call to parents by student.
- Written contract signed by student.
- Safety Plan signed by student, parents, and administration.
- Meet with the administration.
- Meeting with parents involving administration, student, and or team members.
- Daily note monitored by parents and teachers as appropriate.
- Parent accompanying student to class.
- Exclusion from school reward activities, assemblies, field trips, dances, etc.
- Replacement of property in theft and vandalism cases.
- In school suspension.
- Referral to youth court
- Referral to police/juvenile court
- Out of school suspension (1-10 days).
A student/administrator devised plan of action must be agreed upon before a student may return to regular class schedule.
